1. WHO WE ARE

These Terms of Sale apply to purchases made on barefooterra.com (the “Site”). The Site is operated by Terra, trading as barefooterra.com (“we”, “us”, “our”).

2. SCOPE

These Terms of Sale govern the purchase of products sold on the Site and form part of the contract between you and us. By placing an order, you agree to these Terms of Sale, our Shipping Policy, Return & Refund Policy, and Privacy Policy.

3. ELIGIBILITY & SERVICE AREA

We currently sell and ship to customers in the European Union (EU) and the United Kingdom (UK), as stated in our Shipping Policy. We may refuse or cancel orders that fall outside our service area.

4. PRODUCTS & INFORMATION

We aim to display product information as accurately as possible, including descriptions, sizing, and images. However, colors and appearance may vary depending on your device display.

5. PRICES, CURRENCY & PAYMENT

  • Prices: Prices are shown on the Site and may change at any time prior to order placement.
  • Currency: The currency shown at checkout will apply to your order.
  • Payment: Payment is taken at checkout using the payment methods displayed on the Site.
  • Checks: We may perform verification checks and may refuse, cancel, or place an order on hold if we suspect fraud, unauthorized activity, or incorrect billing/shipping details.

6. ORDER PROCESS & CONTRACT FORMATION

  • Order confirmation: After placing an order, you will receive an order confirmation email. This email confirms we have received your order request.
  • Acceptance: The sales contract is formed when we dispatch your order and send a dispatch confirmation (or shipping confirmation) email.
  • Order limits: We may limit or cancel quantities purchased per person, per household, or per order.
  • Stock issues: If a product becomes unavailable after you place your order, we may cancel the order and refund you in full.

7. PROCESSING, DISPATCH & DELIVERY

Delivery timelines and costs are set out in our Shipping Policy.

  • Processing time: Orders are typically processed within 24–48 hours (Monday to Friday, excluding public holidays).
  • Dispatch: Orders are fulfilled and dispatched from our international fulfillment partner warehouse(s). Dispatch location may vary depending on product availability.
  • Tracking: Tracking is provided once your order is dispatched.
  • Delivery estimates: Delivery times are estimates and may vary due to carrier operations, peak periods, weather, or other circumstances outside our control.
  • Address accuracy: You are responsible for providing a complete and accurate shipping address. Address changes can only be made before dispatch.

8. DUTIES & TAXES

No additional taxes or import duties are charged on delivery for orders placed on the Site.

9. CANCELLATIONS

If you need to cancel or change an order, contact us as soon as possible at support@barefooterra.com. We can only attempt to cancel or change orders before dispatch. Once an order has been dispatched, it cannot be canceled and must be handled through our return process.

10. RETURNS, REFUNDS & EXCHANGES

Our return, refund, and exchange terms are described in our Return & Refund Policy. In summary:

  • Returns window: You may request a return within 90 days of delivery, subject to the conditions stated in our Return & Refund Policy.
  • Free returns: Returns are free of charge for customers in the EU and UK, as stated in our Return & Refund Policy.
  • Refund method: Refunds are issued to the original payment method after the return is received and inspected.
  • Exchanges: Exchanges for size are available following the same process described in our Return & Refund Policy, subject to stock availability.

11. STATUTORY CONSUMER RIGHTS (EU/UK)

Nothing in these Terms of Sale affects your statutory rights under applicable consumer protection laws. If a product is defective, damaged, or not as described, you may have legal rights to remedies such as repair, replacement, price reduction, or refund, depending on the circumstances and local rules.

In many EU/UK cases, consumers also have a statutory right to withdraw from a distance purchase within 14 days. Our 90-day return guarantee is offered in addition to (and does not replace) any statutory rights that apply.

12. DAMAGED, INCORRECT OR MISSING ITEMS

If you receive a damaged product, the wrong item, or believe something is missing from your order, contact us at support@barefooterra.com within 48 hours of delivery and include your order number and clear photos where relevant. We will investigate and, where appropriate, arrange a replacement or refund in line with our policies.

13. LIMITATION OF LIABILITY

To the maximum extent permitted by law, we are not liable for indirect or consequential losses. Nothing in these Terms of Sale excludes or limits liability that cannot be excluded under applicable law, including mandatory consumer rights.

14. GOVERNING LAW

These Terms of Sale are governed by applicable European Union law and local consumer protection regulations. Any disputes shall be handled by the competent courts, without prejudice to mandatory consumer rights in your country of residence.
